Terms of Service

These terms are an agreement between you and Michie Dev Solutions, OPC (“we”, “us”) about using the Pace Friends app and Pace Friends Plus (together, “Pace Friends”). By creating an account or using Pace Friends, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Pace Friends.

1. Who can use Pace Friends

• You must be at least 18 years old and able to form a binding contract.
• You may not use Pace Friends if we've previously removed you, or if you're barred from using it under the law that applies to you.
• You may only have one account, and the information in it must be accurate and about you, including your photo, gender and age range.

2. Your account

Keep your password safe and don't share your account. You're responsible for activity on your account. Tell us straight away if you think someone else has accessed it. You can delete your account at any time in Me > Settings > Account.

3. Meeting people and staying safe

Pace Friends suggests people and groups based on information they give us. We don't run criminal background checks or verify everyone's identity, and we can't guarantee that anyone is who they say they are or will behave well. A “verified” badge means only that the person completed the verification we offered at the time, not that we vouch for them.

You're responsible for your own safety and your decisions about whom to meet. We strongly recommend that you:

• Meet in busy, public, well-lit places, and choose routes you know.
• Tell a friend or trusted contact your plans, and use live location sharing and safety check-in.
• Keep conversations in the app until you feel comfortable, and never send money to someone you've met through Pace Friends.
• Leave if you feel uncomfortable, and report or block anyone who makes you feel unsafe.

In an emergency, call your local emergency number. The SOS screen in Pace Friends is a shortcut to call that number and your trusted contacts. It doesn't contact emergency services for you, and it depends on your phone, signal and settings working.

4. Health and exercise

Running and walking involve physical exertion and risks, including injury, illness and, rarely, death. Pace suggestions, plans, distances and run statistics are for general information only and are not medical advice. Check with a doctor before starting or increasing exercise, especially if you have a medical condition. You take part in runs, walks and group sessions at your own risk, and you're responsible for knowing your own limits.

5. Community rules

When you use Pace Friends, you agree not to:

• Harass, threaten, stalk, intimidate or discriminate against anyone.
• Send sexual content, unwanted advances, hate speech or graphic violence.
• Pretend to be someone else, or give false information about yourself.
• Use Pace Friends for dating if the other person isn't interested, or for anything illegal.
• Advertise, sell, spam, or ask people for money.
• Share someone else's personal information or location without their permission.
• Try to access other accounts, scrape data, reverse engineer the app, or get around free-plan limits or security features.
• Create groups or sessions that put people at unreasonable risk.

Group hosts are responsible for their group's description, rules, meeting points and sessions, and for running them safely. Hosts are not our employees or agents.

6. Your content

You own the content you post, such as your photo, messages and group posts. You give us a non-exclusive, worldwide, royalty-free licence to host, store, display and share it as needed to run Pace Friends, for example showing your photo to your matches and delivering your messages. This licence ends when you delete the content or your account, except where others have already received it (such as messages in a chat) or we must keep it by law.

You're responsible for your content and must have the right to post it. We may remove content that breaks these terms.

7. Reports, blocking and removal

There is no tolerance for objectionable content or abusive users on Pace Friends. You can block or report anyone from their profile or chat; blocking takes effect immediately. We review reports within 24 hours and may warn, limit, suspend or remove accounts or content that break these terms or put others at risk, with or without notice. If we remove your account, you may not create a new one.

8. Pace Friends Plus

• What it includes: no ads, and unlimited new connections and group joins. The free plan includes 3 new connections and 1 group join each week; we may change free-plan limits in the future.
• Plans and price: weekly, monthly or yearly. The price and length are shown in the app before you buy, in your local currency.
• Free trial: where offered, a free trial (for example 7 days) turns into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Each person can usually have one free trial.
• Automatic renewal: subscriptions are paid through your Apple Account and renew automatically for the same length at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your account is charged within 24 hours before renewal.
• Cancelling: go to iPhone Settings > your name > Subscriptions > Pace Friends, or tap Manage in Me > Settings. Cancelling stops the next renewal; you keep Plus until the end of the period you've paid for. Deleting the app or your account does not cancel a subscription.
• Refunds: payments are handled by Apple, so refund requests go to Apple at reportaproblem.apple.com under Apple's policies.
• Price changes: if the price changes, Apple will let you know in advance as required, and you can cancel before it takes effect.

9. Ads

Free accounts see ads provided by Google AdMob. We're not responsible for the products or services in third-party ads. How ad data is handled is explained in our Privacy Policy.

10. Third-party services

Pace Friends works with services such as Apple Maps, Apple Health, the App Store and Google AdMob. Your use of those services is also covered by their own terms. We're not responsible for them.

11. Changes to Pace Friends and these terms

We're always improving Pace Friends and may add, change or remove features. We may update these terms; we'll change the date at the top and, for significant changes, tell you in the app. If you keep using Pace Friends after changes take effect, you accept the new terms.

12. Ending these terms

You can stop using Pace Friends and delete your account at any time. We may suspend or end your access if you break these terms, if required by law, or if we stop offering Pace Friends. Sections that by their nature should continue (such as 4, 6, 13, 14 and 15) survive.

13. Disclaimers

Pace Friends is provided “as is” and “as available”. To the fullest extent the law allows, we don't promise that it will be uninterrupted, error-free or secure, that matches, locations, distances or statistics will be accurate, or that other users will behave in any particular way. We're not responsible for the conduct of any user, on or off the app.

14. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, or for injury, harm or loss arising from meeting, running or walking with people you met through Pace Friends. Our total liability for any claim relating to Pace Friends is limited to the amount you paid us for Pace Friends Plus in the 12 months before the claim, or USD 19.99.

Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by our negligence, or for fraud, and nothing affects rights you have as a consumer that can't be waived.

15. Indemnity

To the extent the law allows, you agree to cover our reasonable costs and losses from claims caused by your breach of these terms, your content, or your conduct towards other people.

16. Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines. Disputes will be handled by the courts of Taguig City, Philippines, unless the law where you live gives you the right to bring a claim in your local courts. Please contact us first; most concerns can be solved quickly.

17. Apple App Store terms

If you downloaded Pace Friends from Apple's App Store:

• These terms are between you and us, not Apple. We, not Apple, are responsible for Pace Friends and its content.
• Your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the App Store Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you can notify Apple, and Apple will refund the purchase price (if any) for the app. To the extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for handling any claims relating to the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If someone claims the app infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you're not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you're not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

18. General

These terms and our Privacy Policy are the whole agreement between you and us about Pace Friends. If any part is found unenforceable, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to. You may not transfer your rights under these terms; we may transfer ours as part of a business transfer.
